GENERAL WEB APPS SERVICE TERMS AND CONDITIONS

This document establishes the General Conditions that regulate the use of products or services offered by iTouch Movilisto Portugal, Lda., Identified as Buongiorno, in the subscription and download portals of content in Web Applications (hereinafter “WebApps”). The download or use of any of the products or services offered by iTouch Movilisto Portugal, Lda. By the user implies the full and complete acceptance of these General Conditions, so we recommend that you refrain from using these services if you do not agree with any of the conditions set out in these General Conditions.

1. THE WEB APPS CONTRACTING SERVICES

1.1. ITouch Movilisto Portugal, Lda. Offers the user services for subscribing and downloading content through WebApps for compatible mobile devices. It also offers users the possibility of purchasing some applications through App stores.

The user is responsible for confirming that his Internet access and equipment are compatible with the WebApps before joining / activating, or downloading them.

1.2. The WebApps contracting services offered by iTouch Movilisto Portugal, Lda. Are only available for devices with Android and iOS operating systems (Android versions 4.4.2 and iOS 4 or higher) and for some devices with Windows Phone operating system. The use of services requires an Internet connection using 3G / 4G and / or Wi-Fi technology. Some services are also available for access via PC.

1.3. The Web Apps services offered by iTouch Movilisto Portugal, Lda. Are as follows:

1.3.1. Subscription services

The user requests, on his mobile device, the subscription of a service through a WebApp, which allows access to as many contents as he wishes, by means of the periodic (weekly) payment of a fixed and previously determined price.

The total cost of subscription to the WebApp in question will be indicated in the advertising relating to it and on the service purchase confirmation page.

WebApps subscription services are only available to customers of the NOS, Vodafone and MEO telecommunications operators. Thus, it will not be possible to contract a WebApps subscription service for customers linked to other operators.

The activation of the subscription service of a WebApp will be completed when the user, after being informed of the subscription conditions of the same, expressly accepts the service and authorizes the payment of the amount corresponding to the service through the button available for that purpose in the screen of the mobile device or on your computer.

After confirming acceptance of payment for the service, the user will be able to access or view all products that are available within the WebApp to which he subscribed.

The service will remain active until the user requests it to be canceled. You can do it free of charge at any time by simply using any of the tools available for this purpose:

1.3.2. One-off services

The user requests access to a service through a WebApp in a timely manner, through a single download or limited by session or time. The requested service gives access, according to the purchase model, to one or more specific contents, limited by session or in time, by means of a single payment of a fixed and previously specified price.

In this case, the user personally requests a service and, after being informed and expressly accepting the payment terms of the same through the button available for that purpose on the screen of the mobile device, on the purchase confirmation page, proceeds to download or access requested service.

The user is billed solely for the cost of the requested content / access, and the service is terminated as soon as the user has access to said content or service, or logs out, which ends the session.

The services for downloading content or accesses limited by session or in time, through WebApps are available only to customers of the telecommunications operators NOS, Vodafone and MEO.

Thus, it will not be possible to contract a WebApps subscription service for customers linked to other operators.

After confirming acceptance of payment for the service, the user will be able to access or view all products that are available within the WebApp to which he subscribed.

1.3.2. One-off services

The user is billed solely for the cost of the requested content / access, and the service is terminated as soon as the user has access to said content or service, or logs out, which ends the session.

The services for downloading content or accesses limited by session or in time, through WebApps are available only to customers of the telecommunications operators NOS, Vodafone and MEO.

1.3.3 Services via “App Store”

In cases where the service has the native version available, the user will be able to download the respective Application through the App Stores, namely on Google Play.

The total cost of the downloads will be indicated on the iTouch Movilisto page and on the service purchase confirmation page.

1.4.1. Subscription Version

No streaming / download limit: the customer pays per week and has unlimited access to all content (games, videos, etc.) during the period in which he / she remains with the active subscription.

Weekly subscription price, may vary depending on the service and the telecommunications operator, the type of service, and / or the billing period, whether weekly or fortnightly.

In any case, the final price will be indicated on the confirmation page of the purchase of each service, before proceeding to the payment of the same.

1.5. The WAP / GPRS / UMTS connection, necessary to download / use the contents may have associated costs for the telecommunications operator, not included in the prices previously indicated by iTouch Movilisto Portugal, Lda. These costs depend on the conditions agreed between each user and their operator of telecommunications, so that in no case, iTouch Movilisto Portugal, Lda. may be held responsible for them.

1.6. Payment options

The user will be able to choose between the various payment systems available at the time of purchase.

Access to the different payment systems may vary depending on the telecommunications operator of which the user is a customer and the Internet connection used (3G / 4G or Wi-Fi).

1.6.1. Debit in the account of the telecommunications operator

The amount corresponding to each service will be billed and charged by the telecommunications operator of which the user is a customer and to which is associated the mobile phone number used to purchase the service. In the case of users using mobile devices with prepaid rates, the cost of these services will be automatically charged to the card balance.

1.6.2. Payment services via Google Wallet, Apple InApp or Amazon Payment

Some of the services provided by iTouch Movilisto Portugal, Lda. Can also be purchased from the Application Stores (App Store) to which the user has access (for example Google Play or Apple Store).

The cost of the service purchased through an Application Store will be indicated within the same Store. Any costs of access and navigation to the Service's website and for links to external websites are excluded from the service costs and they are regulated by your mobile operator, as specified in Clause No. 1.6.

A mobile device payment system, such as Google Wallet, Apple InApp or Amazon Payment payment services, allows the user to store information about their bank account and their credit or debit cards, and select a card to be charged each time you make a purchase using your mobile device.

The user will be able to use this payment system on a mobile device to purchase the products or services offered by iTouch Movilisto Portugal, Lda., Accessible for the subscription / download portals / WebApps.

In the event that the user uses a payment service on a mobile device, iTouch Movilisto Portugal, Lda. Guarantees that it does not have access to or be able to view the credit or debit card number entered by the user in the payment service, nor any other information of a banking nature.

For the general conditions related to the payment of the service through the Application Store, the user should consult the General Conditions published in the same store, or contact his telecommunications operator for more information on the use of the payment system on a mobile device.

The payment of Native Apps in Application Stores is legally managed by the heads of each Application Store. Native Apps Payments correspond to payment methods external to iTouch Movilisto Portugal, Lda.

1.7. In cases where the subscription and download services for content via iTouch Movilisto Portugal, Lda. WebApps are provided by a third party, iTouch Movilisto Portugal, Lda. Is only responsible for the content of its WebApps, the third company remaining responsible for the commercialization and payment of services.

In other cases, iTouch Movilisto Portugal, Lda. Acts only as a technological platform that sells WebApps developed by third parties in the provision of Premium and subscription services defined above. It means that it is simply the means for the service offered by a third party to reach the user. In this way, and in these cases, only the company that owns the product that in each case may be responsible for these services.

2. ACCESS TO SERVICES

2.1. The iTouch Movilisto Portugal, Lda. Services described in these General Conditions, are available to all customers of NOS, Vodafone and MEO mobile telecommunications operators, who are over 18 years old (if not available, it will be indicated before purchase).

2.2. Minors may only use the services of iTouch Movilisto Portugal, Lda. With the prior authorization of their parents, guardians or legal representatives, who will in any case be the last responsible for the acts performed by the persons in charge.

2.3. ITouch Movilisto Portugal, Lda is deemed exempt from any responsibilities that may result from the use of the aforementioned service by minors, and in the case of access to the mobile device by minors, parental supervision and control is advised.

2.4. ITouch Movilisto Portugal, Lda. Services are not available to customers of telecommunications services used in roaming. ITouch Movilisto Portugal, Lda. Provides these services solely and exclusively to customers of national operators operating in Portugal.

2.5. Likewise, the user must have all the equipment and software necessary to access its services, including, among others, the mobile device or other access device, as well as having the necessary connection for downloading / accessing the contents correctly configured.

2.6. ITouch Movilisto Portugal, Lda. May interrupt its services in order to carry out repair work, system corrections, maintenance and / or improvements that it considers opportune. It will also be able to modify or interrupt, temporarily or permanently, specific services offered by it or by third parties.

3. USER RESPONSIBILITY

3.1. ITouch Movilisto Portugal, Lda. Is not responsible for losses or damages that may occur due to misuse or illicit use of the contents or services provided by you.

3.2. In this way, the user is obliged not to misuse the iTouch Movilisto Portugal, Lda. System and services, to observe the applicable laws and to respect the rights of third parties, including rights on trademarks, patents, copyrights and any other intellectual and industrial property right.

3.3. The user expressly acknowledges and accepts that the use of these services is not permitted for commercial purposes and any other purposes other than those described in these General Conditions.

4. RESPONSIBILITY OF ITOUCH MOVILISTO PORTUGAL, LDA.

4.1. ITouch Movilisto Portugal, Lda. Does not guarantee the quality, accuracy, reliability, correctness or morality of the data, programs, information or opinions, whatever the origin, that circulate through its platform or through other platforms that the user can access. access through iTouch Movilisto Portugal, Lda.

4.2. The user assumes, under his exclusive responsibility, the consequences, damages or actions that may derive from the access to said contents as well as from their reproduction or diffusion.

4.4. ITouch Movilisto Portugal, Lda. Will not be responsible for cases in which the products or services requested by the user are not delivered or provided correctly when this is due to a cause not attributable to iTouch Movilisto Portugal, Lda. without limiting, (i) the cases in which the user does not correctly request the product or service, (ii) the cases in which the product is not downloaded due to operator connectivity problems, problems with the configuration of the mobile phone or incompatibility between the product or the requested service and the model of the requesting mobile phone when iTouch Movilisto Portugal, Lda. has previously warned about said compatibility.

4.5. This limited warranty and the limitation of liability mentioned in the previous paragraphs will not affect or prejudice the mandatory rights of users.

4.6. ITouch Movilisto Portugal, Lda. Will not be responsible for the websites of third parties that offer applications or for the content / services of third parties that can be accessed through links available between the contents of the pages of iTouch Movilisto Portugal, Lda.

4.7. ITouch Movilisto Portugal, Lda. Does not approve or make use of the products, services, content, information, data, files or any kind of existing materials available on third party websites referred to in the previous paragraph and does not control or be responsible for the quality , reliability and usefulness of the information contained in these "sites".

4.8. Contents that, for whatever reason, may be considered illegal or will be declared as such by a competent authority, will be removed immediately from the product catalog.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

WebApps sites, their content and Intellectual Property rights, the programming and design of these sites are fully protected by copyright, and their reproduction, communication, disclosure is prohibited and distribution unless iTouch Movilisto Portugal, Lda. grants authorization.

5.2. Likewise and except for informational purposes, it is prohibited to copy, reproduce or use this document in whole or in part without the prior written consent of iTouch Movilisto Portugal, Lda.

5.3. All distinct brands that appear on the WebApps website are the property of iTouch Movilisto Portugal, Lda. Or third parties, and their reproduction or distribution in any medium is prohibited, without the proper, prior and express authorization of their owner.

5.4. ITouch Movilisto Portugal, Lda. Reserves the right to unilaterally withdraw any of the contents, services or utilities incorporated in the WebApps owned by iTouch Movilisto Portugal, Lda.

5.5. Itouch is responsible for Itouch Movilisto Portugal. Lda. Enter into the contracts that appear necessary for the use of the content incorporated in the WebApps with the management entities of copyright and related rights existing in Portugal.
